This program targets offenders who have been arrested but not convicted of a crime and are confined in the county jail. If an offender meets certain criteria, the offender may be released into the custody of the Community Corrections Pre-Trial Release Program or “ROR” (Release on Recognizance). Community Corrections Staff will then monitor the offender until the offender’s case has been either adjudicated or dismissed. While under the supervision of the Pre-trial Release Program, the offender will be required to meet conditions set by the court which may include: payment of supervision fees, observing a curfew, participating in treatment, submitting to drug testing, and regular reporting to staff and/or other requirements imposed by the Court.
Eligibility for Pre-Trial Release Consideration:
Defendants eligible for the Pre-Trial Release Program are generally limited to inmates with no prior violent felony convictions, can identify a verifiable address within the region (ability to report in-person), have lawful gainful employment or the ability to gain suitable employment, or who are disabled and receiving a subsistence income (when possible). Bonds cannot exceed an aggregate amount $25,000. Because of the need to verify out of jurisdiction holds or warrants and to allow for positive identification of the accused, Pre-Trial Release Program personnel, unless approved by the Court, will not place someone in the Pre-Trial Release Program until the person has been in jail for a minimum of 72 hours. Participation in the Pre-Trial Release Program is voluntary on the part of the defendant. Participation in the Pre-Trial Release Program is a privilege and not a right for the defendant. The Court, while considering the recommendation of the Pre-Trial Release Officer, ultimately decides which defendants will participate in the Pre-Trial Release Program and when a violation of the program requires the defendant’s re-arrest.
Defendants in particular categories and/or defendants charged with certain offenses are generally not eligible for Pre-Trial Release Program consideration and include:
- Defendants waiting transfer to DOC
- Defendants sentenced to serve County time
- State Probation and Parole violators or Inmates with Federal charges
- Defendants who were previously released on bond and charged with another offense
- Defendants who have been arrested for Failure to Appear
- Defendants charged with felonies involving personal injury to a victim
- Defendants charged with lewd and lascivious acts upon a child
- Defendants charged with forcible sex crimes
- Defendants charged with any violent offense or who have a history of violence
- Defendants charged with Assault involving serious or physical injury to another person
- Defendants charged with Domestic Violence related offenses
- Defendants charged with Selling or Trafficking of a Controlled Substance
- Split sentence cases housed in the Montgomery County Detention Facility
- Defendants with other Agency holds and/or Outstanding Warrants
- Defendants arrested or charged with a new offense while under supervision
