Guidelines for Builders and Developers in Montgomery County

The County Building Permit Program is required by the United States Department of Housing and Urban Development and states that if a community fails to qualify and maintain a building permit program, its citizens will not only be ineligible for flood insurance coverage but will also be ineligible for nearly all forms of Federal financial assistance, including federally insured and guaranteed mortgages i.e., VA and FHA and small business administration loans, as well as, conventional construction and mortgage loans for buildings within the flood hazard areas.

Any proposed construction of a building or structure, or alteration with an area of 200 square feet, or more, is required to be permitted and flood plain designation must be determined. Before starting to build a structure, remodel, or add any addition in Montgomery County, Alabama, that does not lie within the police jurisdiction of any municipality, you MUST obtain a permit from the Building Inspector, Perry L. "Lonnie" McGough, of Montgomery County, Alabama. The office of this inspector is located in the Montgomery County Engineering Department, Room 294 of the County Administration Building Annex I, 100 South Lawrence Street, Montgomery , Alabama telephone 334-832-1312. Rules and regulations to abide by are as follows:

To obtain a permit, you must file an application (which is furnished upon request by this department) and fees shall be paid in accordance with the Schedule of Permit Fees, if applicable. If the structure is in a flood-prone area, you must furnish this department with two (2) sets of plans and specifications and an elevation certificate by a certified engineer. For structure outside a flood-prone area, we do not require any plans or specifications.
The plans and specifications will be reviewed by this office to determine if they meet federal regulations and Standard Building Codes. One set of plans and specifications, if approved will be stamped and mailed back to you with your building permit card. These cards are to be posted in a conspicuous place on the front of the premises. The permit card shall be protected from the weather and in such a position as to permit the inspector to conveniently make the required entry within and shall not be removed until the final inspection. You MUST notify this office when you are ready for an inspection. (Inspections are made only in flood-prone areas).



Inspections are made at three (3) different stages of the construction:

1.
Foundation inspect - to be made after trenches are excavated and forms erected.
2.
Framing inspection - to be made after the roof, all framing, fireblocking and bracing is in place and all pipes, vents, and electrical rough-in are complete.
3.
Final inspection - to be made after the building is complete and ready for occupancy.

NOTE: If the structure is built on pilings, the first inspection will be made after the piling is set and the sub-floor is complete. No work shall be done on any part if this building or structure beyond the point indicated in each successive inspection without first obtaining the approval of the Building Inspector.

For Your Information, Act 119, Section 23 is Quoted:

"Any person, firm, corporation or agency who in violation of this act, fails to obtain the permit required herein or who violates any provision of the building code or zoning ordinances or other regulation, ordinance, code, shall be guilty of a misdemeanor, and upon conviction may be fined no more than $500, or may be imprisoned in the County jail for not more than one year or may be both fined and imprisoned."
